Free assessment terms

1. What this is. The assessment is a free, no-obligation conversation and review of how your business runs. It is not a paid engagement, and booking it does not commit either of us to anything further. If we go on to work together, a separate written agreement covers that work and replaces these terms for it.

2. Confidentiality, both directions. You will likely tell me non-public things about your business: numbers, systems, suppliers, staffing, pricing, plans. I will likely tell you non-public things about mine: how the assessment method works, how I score what I find, what things cost. Each of us agrees to keep the other's non-public information confidential, to use it only in connection with the assessment, and not to pass it to anyone else without permission.

This does not cover information that is already public, that the receiving side already knew, that either of us works out independently, or that a third party is free to share. Either of us can disclose if the law requires it, after telling the other where that is allowed.

This obligation lasts two years from the assessment.

3. What I bring stays mine. The assessment process, the scorecard and how it is calculated, the questions, the frameworks and the general know-how I use are Headway's, and stay Headway's. Nothing here transfers them to you.

4. What you get is yours to use. Any written findings, notes, scorecard or recommendations I give you from the assessment are yours to use inside your own business, for good, at no cost, including after we stop talking. You do not get the right to resell them, publish them as your own, or hand them to a competitor of mine.

5. Your data stays yours. Anything you show me or send me remains yours. I handle personal information in line with Canadian privacy law and the Headway privacy policy.

6. No patient or health records. Do not bring personal health information to the assessment. If you are a clinic or a health-sector business, we can talk about your systems in general terms without it. Handling health records requires a separate written agreement first, and this is not that agreement.

7. It is a first look, not professional advice. An hour is enough to find where the problems are, not to be sure of every answer. What I tell you in the assessment is a preliminary view offered in good faith. It is not legal, accounting, tax or regulatory advice, and I am not guaranteeing a particular result. Get proper advice before making a decision that depends on one.

8. Recording. I will not record the meeting without telling you and getting your agreement first. If you book by phone, the call may be recorded and transcribed, which is covered in the privacy policy.

9. Cancelling. Either of us can cancel or reschedule. No fee either way.

10. Ontario law. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
